Buy American Act--Trade Agreements--Balance of Payments Program Certificate (March 1998)
(a) Definitions. Caribbean Basin country end product, designated country end product, domestic end product NAFTA country end
product, nondesignated country end product, qualifying country end product, and U.S. made end product have the meanings given
in the Buy American Act--Trade Agreements--Balance of Payments Program clause of this solicitation.
(b) Evaluation. Offers will be evaluated in accordance with the policies and procedures of Part 225 of the Defense Federal
Acquisition Regulation Supplement. Offers of foreign end products that are not U.S. made, qualifying country, designated country,
Caribbean Basin country, or NAFTA country end products will not be considered for award, unless the Contracting Officer determines
that there are no offers of such end products; or the offers of such end products are insufficient to fulfill the requirements;
or a national interest exception to the Trade Agreements Act is granted.
(c) Certifications. (1) The Offeror certifies that--
(i) Each end product, except the end products listed in paragraph (c)(2) of this provision, is a domestic end product; and
(ii) Components of unknown origin are considered to have been mined, produced, or manufactured outside the United States or
a qualifying country.
(2) The Offeror must identify all end products that are not domestic end products.
(i) The Offeror certifies that the following supplies qualify as "U.S. made end products" but do not meet the definition of
"domestic end product":
